LADYBUQ ART STUDIO ONLINE STORE REGULATIONS

Effective as of May 28, 2015

§ 1

GENERAL PROVISIONS

  1. The online store available at www.ladybuqart.pl is operated by Dariusz Bełch, conducting business under the name: "LadyBuq" Art Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, Tax ID (NIP): 813-30-94-872, Regon: 18-00-10-042.

  2. Contact details for the LadyBuq Online Store:

  3. These Regulations set forth, among other things, the rules and conditions for using the Online Store and include, in particular, the following types and scope of services:

    • rules for registering and using the Online Store;

    • rules and conditions for placing Orders for Goods in the Online Store;

    • rules and conditions for concluding Sales Agreements using the services offered by the Online Store;

    • rules for executing such agreements for the assortment offered by LadyBuq;

    • complaint procedures;

  4. All goods available in the Online Store are brand new. The Seller informs that the goods offered in the Online Store are handmade.
    Each presented item is made only after the Customer places an order.
    Therefore, LadyBuq uses only natural products and materials for production, which may be characterized by slight differences in color, thickness, discoloration, and other features related to the nature of genuine leather.

  5. LadyBuq reserves that the color of the internal pockets of the product is random.

  6. To use the Online Store, including browsing the assortment and placing orders, the following minimum technical requirements must be met:

    • having a computer or other multimedia device with Internet access;

    • having an Internet browser:

      • Internet Explorer 8.0 or newer with ActiveX, JavaScript, and Cookies enabled, or

      • Mozilla Firefox 22.0 or newer with Java applets, JavaScript, and Cookies enabled, or

      • Google Chrome 28.0 or newer with Java applets, JavaScript, and Cookies enabled, or

      • Opera 12.0 or newer with Java applets, JavaScript, and Cookies enabled, or

      • Apple Safari 5.0 or newer with Java applets, JavaScript, and Cookies enabled;

    • having an active email account;

    • recommended minimum screen resolution: 1024 x 768 pixels.

§ 2

DEFINITIONS

ORDER FULFILLMENT TIME – means the number of business days in which LadyBuq will fulfill/produce the order placed by the Customer through the Online Store.
Order fulfillment time does not include:

  • the time of handing over the ordered goods to a courier company or the Polish Post for delivery to the Customer;

  • the time of delivery of the ordered goods by the courier company to the address indicated by the Customer in the order.
    The order fulfillment time for goods ordered from LadyBuq is from three to fifteen business days. LadyBuq will make every effort to ensure the shortest possible fulfillment time.

BUSINESS DAYS – days of the week from Monday to Friday, excluding public holidays in the Republic of Poland.

LIMITED EDITION – goods produced by LadyBuq in limited quantities; orders will be processed in the order received until stock is depleted. In such cases, LadyBuq reserves the right to withdraw from the contract.

CUSTOM ORDER – a service provided by LadyBuq consisting of placing an order by the Customer via the Online Store for the creation of a product based on the Customer’s design/idea.
A custom order will be executed by LadyBuq only after all essential elements of the order (design: shape, color, price) have been agreed upon by both parties and finally approved by email by both the Customer and LadyBuq.
Modifications (e.g., color, shape, handle/strap length, additional pocket) to products offered on the LadyBuq Online Store website are also considered custom orders.
Projects created as custom orders are also subject to individual pricing by LadyBuq.
Custom orders cannot be canceled or returned.
Custom orders are processed after payment has been credited.

LadyBuq – the Seller, i.e., "LadyBuq" Art Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, NIP: 813-30-94-872, Regon: 18-00-10-042.

CUSTOMER – a natural person placing an Order in the Online Store, who is at least 18 years old and has full legal capacity.

CONSUMER – a Customer who is a natural person making a legal transaction with LadyBuq not directly related to their business or professional activity, in particular placing an order in the Online Store (as per Article 221 of the Polish Civil Code).

CONFIRM PURCHASE, ORDER WITH OBLIGATION TO PAY – means placing an order by the Customer with an obligation to pay.

SERVICE – the websites through which the Seller operates the Online Store.

STORE – the Online Store operating at www.ladybuqart.pl, operated by LadyBuq Art Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland.

GOODS – a product available in the Online Store, for which an Order can be placed.

DISTANCE CONTRACT – a contract concluded at a distance by the Parties, in the absence of the simultaneous presence of both Parties; the contract is concluded using remote communication channels available in the Store.

ORDER – a declaration of intent by the Buyer, based on which they purchase goods offered by LadyBuq. The order contains all detailed information necessary for its execution.

§ 3

RULES FOR USING THE SERVICE – CREATING A CUSTOMER ACCOUNT, LOGGING IN

  1. The condition for using the Online Store is the Customer’s registration, acceptance of these Terms and Conditions, and the Customer’s consent to the processing of their personal data for the purpose of order fulfillment by LadyBuq.

  2. Registration on the Store’s Website is voluntary and free of charge.

  3. By completing the registration form, the Customer declares that:

    • the information provided is complete and accurate,

    • they have read and agree to comply with these Terms and Conditions.

  4. The Customer may register a Customer Account in the Online Store by clicking the "Create Account" tab on the main page of the Online Store at www.ladybuqart.pl, or during the order placement process via the Online Store.

  5. During Registration in the LadyBuq Online Store, the Customer is required to provide the following information:

    • an email address, which will serve as the Customer’s login,

    • a password, which the Customer will use to log in to the account,

    • first and last name.

  6. Upon correctly entering the above registration data into the form and selecting the "create account" option, the system will automatically send an email to the address provided by the Customer during registration, containing instructions on how to activate the account.

  7. After registering the Customer Account, the Customer may log in to the Online Store by entering the email address and password provided during registration.

  8. The Customer may browse the Online Store’s assortment and place orders without registering a Customer Account. However, a Customer who has registered a Customer Account in the LadyBuq Online Store has the ability to: track order history and monitor the status of placed orders.

  9. Data marked as mandatory is necessary to create a Customer Account and to process and fulfill orders placed in the Online Store. Providing data marked as mandatory is voluntary but required to create a Customer Account. Personal data not marked as mandatory is optional and not required to create a Customer Account.

  10. The agreement for the provision of electronic services, enabling the Customer to create and use a Customer Account on the Online Store’s website, is concluded at the moment the Customer receives an email confirming the registration/creation of the Customer Account.

    § 4

    PLACING AND ACCEPTING ORDERS

    1. The subject of orders in the LadyBuq Online Store are goods available in the offer presented on the website www.ladybuqart.pl.

    2. The following are required elements in the order placement procedure:

      • The Customer must read and accept these Terms and Conditions, which the Customer confirms by checking the appropriate box before finalizing the order. Failure to accept these Terms and Conditions during the order placement procedure will prevent the Customer from purchasing goods via the Online Store.

      • The Customer must provide their personal data as indicated in the order form (fields marked as mandatory) and, by checking the appropriate box before finalizing the order, consent to the processing of their personal data provided during the order process for the purpose of fulfilling and servicing the order placed in the Online Store.

    3. To place an Order via the Online Store, the Customer should access the Online Store website and follow the subsequent steps based on the prompts and information displayed on the site.

    4. Orders are placed using the Order Form, which is available after the Customer logs into their Customer Account in the Online Store or by using the form that allows placing an Order without registration. Products are selected by adding them to the cart (clicking "Add to Cart").

    5. Placing an order via the Online Store website www.ladybuqart.pl consists of:

      • selecting the product and adding it to the cart,

      • selecting the delivery method,

      • selecting the payment method,

      • completing the order form,

      • confirming and submitting the order by clicking the "Confirm Purchase, Order with Obligation to Pay" button.

    6. In the order form referenced above, the following information must be provided:

      • first and last name of the Customer/Consumer,

      • address of the Customer/Consumer,

      • phone number of the Customer/Consumer,

      • email address of the Customer/Consumer,

      • recipient’s information and delivery address, if the ordered product is to be delivered to an address other than that of the Customer/Consumer.

    7. After the Customer has completed all required fields in the Order Form and selected the delivery method and payment method, a summary of the Order will appear on the screen, including, among other things:

      • the ordered product(s),

      • the unit price of each product and the total price if ordering more than one product,

      • the delivery cost in the form selected by the Customer.

    8. During the order placement procedure—up until the moment the "Confirm Purchase, Order with Obligation to Pay" button is clicked—the Customer has the ability to modify the order, particularly regarding product selection, delivery area, payment method, and the data provided in the order form. To modify the order, click the "Edit/Back" button visible on the Online Store website during the order placement process.

    9. The Order is submitted by clicking the "Order with Obligation to Pay" button.

    10. Submission of the Order by the Customer constitutes an offer to LadyBuq to conclude a Sales Agreement for the products specified in the Order.

    11. Upon receiving the Order, LadyBuq will send the Customer a message confirming receipt of the Order ("Confirmation" or "Order Receipt Confirmation") to the email address provided by the Customer. The Sales Agreement for the product is concluded when the Customer receives the aforementioned message. The content of this message, which constitutes confirmation of the conclusion of the sales agreement, will include, among other things, the Order number placed by the Customer.

    12. The sales agreement is concluded in Polish and is consistent with these Terms and Conditions and applicable law.

    13. The provision of electronic services by LadyBuq, enabling Customers to place orders for goods offered by LadyBuq via the Online Store, is free of charge and one-time in nature. The service ends immediately after the order is fulfilled by LadyBuq.

    14. If, after the Customer places an order for multiple products, it turns out that part of the order cannot be fulfilled within the time specified for order fulfillment, LadyBuq will promptly inform the Customer at the email address provided in the order form or in the Customer Account (if the order was placed using the Customer Account). In such a case, the Customer may cancel the order in the part that cannot be fulfilled within the specified time or cancel the entire order by informing LadyBuq via email at ladybuq@wp.pl or in writing at the LadyBuq postal address (as specified above).

    15. If a product is unavailable in the Online Store or the Order cannot be fulfilled within the timeframe specified in these Terms and Conditions, LadyBuq reserves the right to cancel the Order.

    16. In the cases specified in points 14 and 15, if the Customer has already paid in advance for the ordered product, LadyBuq will promptly refund the Customer the paid price or the relevant portion thereof if the order is fulfilled only in part. The refund will be made using the same payment method used by the Consumer, unless the Consumer expressly agrees to another refund method—in any case, the Consumer will not incur any fees related to the refund.

    17. The Seller reserves the right to refuse to confirm receipt of the Order or to cancel the fulfillment of the Order in any of the following cases:

    • the Order Form was not completed in full or was completed incorrectly;

    • the order was placed in violation of the provisions of these Terms and Conditions.


      § 5

      PRICES OF GOODS IN THE ONLINE STORE

      1. All prices listed in the Store are given in Polish zloty (PLN) and include VAT.

      2. Prices do not include shipping costs. Shipping costs are added as a separate item in the Order summary (cart value). Information about the shipping cost is provided before the conclusion of the sales contract.

      3. The prices provided by LadyBuq are binding at the time the Order is placed through the www.ladybuqart.pl website.

      4. Payment for the ordered goods may be made by:

        • traditional bank transfer (before delivery of the goods) to the LadyBuq account at Millenium Bank

        • cash on delivery – payment in cash to the courier upon receipt of the shipment;

        • via the PAY PAL online payment system;

        • by payment card (Visa, MasterCard);

        • personal pickup at the LadyBuq headquarters.

        1. Goods ordered via the Online Store are delivered within the territory of the Republic of Poland, European Union countries, and to countries outside the European Union.

        2. Delivery times and costs vary depending on the country of delivery specified when placing the order:

          Within the Republic of Poland:

          • Orders placed in the LadyBuq Online Store are delivered via the FEDEX courier company (01-222 Warsaw) or Polish Post S.A., ul. Stawki 2, 00-940 Warsaw;

          • Shipments are sent from Monday to Friday, except for public holidays in the Republic of Poland;

          • Shipping costs:

            • Prepayment – 25.00 PLN,

            • Cash on delivery – 25.00 PLN,

            • Personal pickup – 0 PLN;

          • The shipping costs may depend on the number of items ordered;

          • The delivery time should be added to the order fulfillment time, i.e., the time it takes the courier company to deliver the shipment to the address specified by the Customer.

          Within the European Union:

          • Orders placed in the LadyBuq Online Store are delivered via the FEDEX courier company. If the Customer does not provide a contact phone number, LadyBuq will deliver the shipment via Polish Post or cancel the order;

          • Shipments are sent from Monday to Friday, except for public holidays in the Republic of Poland;

          • Shipping costs:

            • Prepayment – 80.00 PLN;

          • The shipping costs depend on the number of items ordered;

          • The delivery time should be added to the order fulfillment time, i.e., the time it takes the courier company to deliver the shipment to the address specified by the Customer.

          Outside the European Union:

          • Orders placed in the LadyBuq Online Store are delivered via the FEDEX courier company or Polish Post. If the Customer does not provide a contact phone number, LadyBuq will deliver the shipment via Polish Post or cancel the order;

          • Shipments are sent from Monday to Friday, except for public holidays in the Republic of Poland;

          • Shipping costs:

            • Prepayment – 57.85 USD – this amount applies only to delivery locations with predetermined shipping costs for LadyBuq. If the delivery location is in a tariff zone with a higher fee than the amount indicated above, LadyBuq will inform the Customer accordingly;

          • The shipping costs depend on the number of items ordered;

          • The delivery time should be added to the order fulfillment time, i.e., the time it takes the courier company to deliver the shipment to the address specified by the Customer;

          • The Customer may be charged customs duties, about which LadyBuq will inform the Customer by email.

        3. If the ordered goods are to be delivered within the Republic of Poland, the European Union, or to countries outside the European Union, the delivery costs are borne by the Customer.

        4. The order fulfillment time for orders placed via the Online Store is from three (3) to fifteen (15) business days, counting from:

          • In the case of cash on delivery selected by the Customer when placing the order – from the date LadyBuq sends the Customer an email confirming acceptance of the order for fulfillment;

          • In the case of payment by credit card (Visa, MasterCard), online bank transfer, or traditional bank transfer selected by the Customer when placing the order – from the date LadyBuq receives confirmation of successful payment from the payment processor.

        5. Goods ordered via the Online Store are delivered together with a receipt (VAT invoice) issued by LadyBuq covering the subject of the order.

        6. Within the Republic of Poland, if the Customer does not request a VAT invoice, LadyBuq will include a proof of purchase in the form of a receipt with the ordered goods.

          1. For goods ordered via the Online Store and delivered to an address within the territory of the Republic of Poland, the Customer may choose the following methods of payment for the price and delivery costs when placing the order:

            • Cash on delivery – the Customer pays the courier upon receipt of the goods (cash on delivery) or pays for the ordered goods directly at the LadyBuq headquarters (personal pickup);

            • In advance of receiving the ordered goods (prepayment) – electronic payment by credit card (Visa, MasterCard) / online bank transfer via electronic banking;

            • Via the PayPal online payment system / traditional bank transfer to the LadyBuq account (PLN / € / $).

          2. If the goods ordered via the Online Store are to be delivered to an address outside the Republic of Poland (only EU countries):

            • In advance of receiving the ordered goods (prepayment) – electronic payment by credit card (Visa, MasterCard) / online bank transfer via electronic banking;

            • Via the PayPal online payment system / traditional bank transfer to the LadyBuq account (PLN / € / $).

          3. If the goods ordered via the Online Store are to be delivered to an address outside the European Union (e.g., Canada, USA, other):

            • In advance of receiving the ordered goods (prepayment) – electronic payment by credit card (Visa, MasterCard) / online bank transfer via electronic banking via the PayPal system / traditional bank transfer to the LadyBuq account (PLN / € / $).

          4. A Customer who selects prepayment when placing an order should pay the price and delivery costs within 7 days from the date of receiving an email confirmation of order receipt from LadyBuq.

          5. A Customer who selects cash on delivery when placing an order is required to make payment upon receipt of the shipment containing the ordered goods.

          6. Payment by credit card (Visa, MasterCard) or online bank transfer is processed via the PayPal online payment system3456.LadyBuq informs that products offered in the Online Store are made only after the Customer places an order and pays the full price. The only exception is orders for which cash on delivery is selected as the payment methodlure to pay the Order price within 7 business days from the date the Order is placed is considered a cancellation of the Order. After the indicated period, LadyBuq will cancel the Order.



            § 6

            FORMS OF PAYMENT

            1. For goods ordered via the Online Store and delivered to the address indicated by the Customer within the territory of the Republic of Poland, the Customer may choose the following payment methods for the price and delivery costs when placing the order:

              • Cash upon receipt of the ordered goods – the Customer pays upon receiving the goods delivered by the courier company (cash on delivery), or the Customer pays for the ordered goods directly at the LadyBuq headquarters (personal pickup);

              • In advance of receiving the ordered goods (prepayment) – electronic payment by credit card (Visa, MasterCard) / online bank transfer via electronic banking;

              • Via the PayPal online payment system / traditional bank transfer to the LadyBuq account (PLN / € / $).

            2. If the goods ordered via the Online Store are to be delivered to the address indicated by the Customer outside the territory of the Republic of Poland (applies only to European Union countries):

              • In advance of receiving the ordered goods (prepayment) – electronic payment by credit card (Visa, MasterCard) / online bank transfer via electronic banking;

              • Via the PAY PAL online payment system / traditional bank transfer to the LadyBuq account (PLN / € / $).

            3. If the goods ordered via the Online Store are to be delivered to the address indicated by the Customer outside the European Union (e.g., Canada, USA, other):

              • In advance of receiving the ordered goods (prepayment) – electronic payment by credit card (Visa, MasterCard) / online bank transfer via electronic banking via the PAY PAL system / traditional bank transfer to the LadyBuq account (PLN / € / $).

            4. A Customer who selects prepayment when placing an order should pay the price and delivery costs within 7 days from the date of receiving an email confirmation of order receipt from LadyBuq.

            5. A Customer who selects cash upon delivery when placing an order is required to make payment upon receipt of the shipment containing the ordered goods.

            6. Payment by credit card (Visa, MasterCard) or online bank transfer is processed via the PayPal online payment system.



              § 7

              ORDER FULFILLMENT, TIMEFRAME, METHOD, AND COST OF DELIVERY OF ORDERED GOODS

              1. Goods ordered through the Online Store are delivered within the territory of the Republic of Poland, European Union countries, and to countries outside the European Union.

              2. Delivery times and costs vary depending on the country of delivery specified when placing the order:

                Within the Republic of Poland:

                • Orders placed in the LadyBuq Online Store are delivered via the FEDEX courier company (01-222 Warsaw) or Polish Post S.A., ul. Stawki 2, 00-940 Warsaw;

                • Shipments are sent from Monday to Friday, except for public holidays in the Republic of Poland;

                • Shipping costs:

                • Shipments are sent from Monday to Friday, except for public holidays in the Republic of Poland;

                • Shipping costs:

                  • Prepayment – 80.00 PLN;

                • The indicated shipping costs depend on the number of items ordered;

                • The order fulfillment time should be supplemented by the time it takes the courier company to deliver the shipment to the address specified by the Customer.

                Outside the European Union:

                • Orders placed in the LadyBuq Online Store are delivered via the FEDEX courier company or Polish Post. If the Customer does not provide a contact phone number, LadyBuq will deliver the shipment via Polish Post or cancel the order;

                • Shipments are sent from Monday to Friday, except for public holidays in the Republic of Poland;

                • Shipping costs:

                  • Prepayment – 57.85 USD – this amount applies only to delivery locations with predetermined shipping costs for LadyBuq. If the delivery location is in a tariff zone with a higher fee than the amount indicated above, LadyBuq will inform the Customer accordingly;

                • The indicated shipping costs depend on the number of items ordered;

                • The order fulfillment time should be supplemented by the time it takes the courier company to deliver the shipment to the address specified by the Customer;

                • The Customer may be charged customs duties, about which LadyBuq will inform the Customer by email.

              3. If the ordered goods are to be delivered within the Republic of Poland, the European Union, or to countries outside the European Union, the delivery costs are borne by the Customer.

              4. The order fulfillment time for orders placed via the Online Store is from three (3) to fifteen (15) business days, counting from:

                • In the case of cash on delivery selected by the Customer when placing the order – from the date LadyBuq sends the Customer an email confirming acceptance of the order for fulfillment;

                • In the case of payment by credit card (Visa, MasterCard), online bank transfer, or traditional bank transfer selected by the Customer when placing the order – from the date LadyBuq receives confirmation of successful payment from the payment processor.

              5. Goods ordered via the Online Store are delivered together with a receipt (VAT invoice) issued by LadyBuq covering the subject of the order.

              6. Within the Republic of Poland, if the Customer does not request a VAT invoice, LadyBuq will include a proof of purchase in the form of a receipt with the ordered goods.

              7. LadyBuq informs that products offered in the Online Store are made only after the Customer places an order and pays the full price. The only exception is orders for which cash on delivery is selected as the payment method.

                § 8

                CONSUMER RIGHT OF WITHDRAWAL FROM THE CONTRACT

                1. Sales contracts concluded through the Online Store are distance contracts within the meaning of the Act of May 30, 2014, on consumer rights. Therefore, the Buyer who is a Consumer, in cases and under the terms specified in the above Act, has the right to withdraw from the concluded sales contract within 14 days from the date of delivery of the goods, without giving any reason.

                2. However, in the case of goods with properties specified by the Consumer in the order placed or closely related to their person, this right does not apply, as provided in Article 38 point 3 of the above Act (Custom Order).

                3. Instructions on the right of withdrawal, including information on how and when to exercise the right of withdrawal and the costs of returning the goods in the event of withdrawal (which are borne by the Consumer), are attached as Appendix No. 1 to these Terms and Conditions.

                4. The statement of withdrawal from the contract may be accompanied by the physical return of the goods. The Consumer may use the withdrawal form, the template of which is attached as Appendix No. 2 to these Terms and Conditions. In the event of withdrawal, the cost of returning the goods is borne by the Buyer.

                5. In the event of withdrawal, LadyBuq is obliged to refund the Buyer an amount equal to the purchase price of the returned goods and the costs of delivery, except that if the Consumer chose a delivery method other than the cheapest standard delivery offered by LadyBuq, LadyBuq is not obliged to refund the additional costs incurred by the Consumer.

                6. The completed form or statement of withdrawal should be sent to: “LadyBuq” Art Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, or by email to: shop@ladybuqart.pl.

                7. In the event of withdrawal, LadyBuq will promptly, no later than within 14 days from the date of receiving the Consumer’s statement of withdrawal, refund all payments received from the Consumer, including the cost of delivery, except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest standard delivery offered by LadyBuq.

                8. In the event of withdrawal by a Client making purchases from outside the European Union, LadyBuq will only refund the equivalent of the price paid for the returned goods.

                9. The refund will be made by LadyBuq using the same payment methods as those used by the Consumer, unless the Consumer expressly agrees to a different method of refund—in any case, the Consumer will not incur any fees related to the refund.

                10. In the event of withdrawal, the Consumer is obliged to return the goods immediately, but no later than within 14 days from the day on which they informed LadyBuq of the withdrawal. To meet the deadline, it is sufficient to send the goods before the 14-day period expires to: “LadyBuq” Art Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, with the note “Return”.

                11. The goods should be returned to the above address in a rigid box, e.g., the one in which the goods were delivered to the Consumer. The returned goods must be sent in an undamaged condition with tags and proof of purchase (receipt). LadyBuq stipulates that the returned goods must be properly packaged so that they are not creased or damaged during transport.

                12. LadyBuq may withhold the refund of payments received from the Consumer until the goods are returned or the Consumer provides proof of having sent back the goods, whichever event occurs first.

                13. The Consumer is responsible for any diminished value of the goods resulting from handling them other than what is necessary to establish the nature, characteristics, and functioning of the goods.

                § 9

                GENERAL INFORMATION REGARDING COMPLAINTS ABOUT SOLD GOODS

                1. If, in the Client’s opinion, the purchased goods are defective, regardless of other rights, the Client may request repair or replacement of the goods with new ones. To do so, the Client should:

                  • return the goods (if possible, in the original packaging and with proof of purchase) to: “LadyBuq” Art Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland, with the note “Complaint”;

                  • send or otherwise submit to the above address a written statement containing the complaint about the defective goods; the Client may use the complaint form, the template of which is attached as Appendix No. 3 to these Terms and Conditions;

                  • indicate in the above statement whether they are requesting repair or replacement with new, defect-free goods, specify the nature of the defect and the date it occurred;

                  • provide contact details for handling the complaint, including mailing address, email address, and phone number.

                2. LadyBuq will review the complaint within 14 days from the date it is submitted by the Client.

                3. If the complaint is resolved in favor of the Client, LadyBuq will, as requested by the Client, repair the goods or replace the defective goods with goods of full value. LadyBuq may refuse the Client’s request for repair if it is impossible or, compared to the alternative (i.e., replacement with new, defect-free goods), would involve excessive costs.

                4. LadyBuq covers justified complaint costs, including the documented cost of sending the goods subject to complaint by the Client.

                5. Discoloration or dye transfer is not considered a complaint, as the products are made from natural leather. LadyBuq informs that only natural leather is used, which, as a natural product, may be characterized by differences in texture, shade, thickness, marks, scars, or wrinkles. These differences are not considered defects but are characteristic features of natural leather.

                6. Any discrepancies regarding the dimensions of a handbag should be consulted with LadyBuq, as for irregularly shaped handbags, the dimensions provided by LadyBuq on the Online Store website and those measured by the Client may differ. This may result from the Client measuring the handbag in a different place than LadyBuq did.

                7. Differences resulting from individual computer settings (color, proportions, etc.) cannot be the basis for a complaint.

                8. LadyBuq is obliged to deliver goods to Clients free from physical and legal defects. LadyBuq is liable to Clients for defects in the goods under the principles set out in the Civil Code of April 23, 1964 (consolidated text: Journal of Laws of 2014, item 121, as amended).

                § 10

                OUT-OF-COURT METHODS OF HANDLING COMPLAINTS AND CLAIMS

                Clients are informed that they have the option to use out-of-court methods of handling complaints and pursuing claims. Detailed information on the possibility of using such methods is available at the offices and on the websites of district (municipal) consumer ombudsmen, Provincial Inspectorates of Trade Inspection, and social organizations whose statutory tasks include consumer protection.

                PROCESSING OF CLIENTS’ PERSONAL DATA

                This Privacy Policy sets out the rules for the processing of personal data and cookies collected by the online store at http://www.ladybuqart.pl/ (hereinafter referred to as the "Online Store"), which is operated by Ladybuq Art Studio Dariusz Bełch, Kraczkowa 1079a, 37-124 Kraczkowa, Poland.

                The protection of information regarding Users of our Service is of the utmost importance to us; therefore, we make every effort to ensure that you feel safe entrusting us with your personal data when using our website. This privacy policy explains the principles and scope of our processing of your personal data, your rights, and our obligations as a data controller.

                Ladybuq Art Studio processes Users’ personal data in order to properly perform contracts concluded through the online store at www.ladybuqart.pl (the "Service"). This means that this data is needed in particular for:

                • registering in the Service

                • concluding a contract

                • making settlements

                • delivering goods ordered by the User

                • enabling the User to exercise all consumer rights (e.g., withdrawal from the contract).

                If you have consented to receive information about news and promotions, Ladybuq Art Studio processes your data to send you its own commercial information, such as current promotions or sales.

                The Client acknowledges that Personal Data appearing on the outside of the package, such as on the shipping label, is visible to third parties, which, however, cannot be considered a Data Protection Breach.

                4. In the event of withdrawal from the contract or acceptance of a complaint, if the refund is made directly to the User’s bank account, we ask for the account number to process the refund.

                Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.

                We process your personal data with your consent, given at the time of registration in the Service and when confirming a transaction in the Service.

                Providing consent to the processing of your personal data is entirely voluntary; however, lack of consent makes it impossible to register in the Service and make purchases via the Service.

                § 12

                FINAL PROVISIONS

                1. If any provision of these Terms and Conditions is found to be invalid or ineffective in the manner prescribed by law, this does not affect the validity or effectiveness of the remaining provisions. In place of the invalid provision, the provision closest to the purposes of the invalid provision and the entire Terms and Conditions will apply.

                2. Contracts are concluded in Polish.

                3. These Terms and Conditions are available electronically on the website www.ladybuqart.pl and for review at the LadyBuq headquarters. It is presumed that by placing an order, the Client has read and accepted these Terms and Conditions.

                4. LadyBuq informs that colors visible on digital media may slightly differ from the actual color.

                5. LadyBuq informs that it is not responsible for the indication of an incorrect delivery address by the Client, and the costs associated therewith will be borne directly by the Client.

                6. LadyBuq informs that it responds to all emails from Clients promptly, but no later than within 7 days from the date of receipt.

                7. If the Client fails to collect a previously ordered shipment via the Online Store, LadyBuq reserves the right to seek reimbursement for costs incurred in attempting to deliver the shipment, as well as compensation for any resulting damage.

                8. The Client is obliged to check the condition of the shipment in the presence of the courier.

                9. By using the Online Store website (and the Online Store itself), the Client/Consumer is obliged to:

                  • not provide unlawful content and not use the Online Store or its website in a manner contrary to the law;

                  • not violate the personal rights or other rights of third parties;

                  • use all information available on the Online Store website (including commercial, marketing, and promotional materials) only for personal use;

                  • comply with the laws in force in the Republic of Poland and adhere to these Terms and Conditions and the general rules governing the functioning of the Internet;

                  • not undertake unlawful actions that harm the good name of LadyBuq.

                10. LadyBuq reserves the right to amend these Terms and Conditions for legal or organizational reasons. Each Client will be informed of any changes by posting a notice about the change on the Online Store website www.ladybuqart.pl.

                11. In the case of changes to these Terms and Conditions, all contracts, orders placed before the effective date of the amendment will be executed in accordance with the Terms and Conditions in force on the date of conclusion of the contract, placing the order, or making a reservation by the Client.

                12. In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Act of April 23, 1964—the Civil Code (consolidated text: Journal of Laws of 2014, item 121, as amended), and for Clients who are Consumers, also the provisions of the Act of May 30, 2014, on consumer rights (Journal of Laws of 2014, item 827).

                13. The appendices to the Terms and Conditions are: Client instruction—Appendix No. 1, withdrawal form template—Appendix No. 2, and complaint form template—Appendix No. 3 to the Terms and Conditions.

                14. These Terms and Conditions come into force on June 7, 2015, and apply to contracts concluded from that date.
